Waverley Tree Preservation Rules
Most trees in Waverley are protected under Part B3 (Landscaping, Biodiversity and Tree Preservation) of the Waverley DCP, which operates under the State Environmental Planning Policy (Biodiversity and Conservation) 2021. Council approval is generally required before removing, pruning, damaging or otherwise working on protected trees.
- Council approval: generally required for any tree 3 metres or more in height or with a canopy spread of 3 metres or more. The same controls apply to trees on the Waverley Register of Significant Trees, heritage items, trees forming part of a heritage item, and trees within a Heritage Conservation Area.
- Applications: a Tree Management Application is generally required before pruning, removing or carrying out works above or below ground that may affect a protected tree, unless an exemption applies.
- Heritage and significant trees: extra controls apply to Register trees, heritage-listed properties and Heritage Conservation Areas, and a DA may be required depending on the proposal.
- Exemptions: Council exempts specified vegetation and circumstances set out in its Tree Management Guidelines. Confirm exemptions before work starts, as heritage and significant tree protections may still apply.
- Development and tree protection: where development affects retained trees, Council may require an arborist report, Arboricultural Impact Assessment, Tree Protection Plan to AS 4970 and project arborist inspections where required by consent.
