City of Sydney Tree Rules & Regulations

The City of Sydney protects trees under Clause 5.9 of the Sydney Local Environmental Plan 2012 and Section 3.5.3 – Tree Management of the Sydney Development Control Plan 2012.

Before pruning or removing a tree on private property, it is important to determine whether the tree is protected under the DCP or heritage-listed, as this determines whether a tree permit or Development Application is required.

Arbor Express prepares AQF Level 5 Arborist Reports that help homeowners, builders, architects and developers satisfy the City of Sydney's planning requirements.

  • Council approval is generally required before pruning, removing, damaging, poisoning, ringbarking or destroying a protected tree on private property.
  • Heritage-listed trees generally require a Development Application, while other protected trees are typically managed through a tree permit application.
  • Some work may be exempt, including certain listed species, dead, dying or immediately dangerous trees confirmed by a qualified arborist (minimum AQF Level 3), and limited pruning that removes no more than 5% of the canopy and complies with AS 4373.
  • Where development may affect retained trees, Council may require an Arboricultural Impact Assessment, Tree Protection Plans and construction monitoring as part of the Development Application process.
  • Where a tree removal permit is granted, replacement planting is generally required to minimise canopy loss, with Council specifying the required size and mature height of replacement trees.

Do I need Council approval to remove a tree?

In most situations, yes. Before pruning or removing a tree on private property, you should first determine whether it is protected under the Sydney DCP 2012 or is heritage-listed. Heritage-listed trees generally require Development Consent, while other protected trees are usually managed through a tree permit application.

Is my tree exempt from Council approval?

Several species are exempt from permit requirements unless they appear on the Register of Significant Trees or the Heritage Trees List, including African Olive, Cocos Palm, Privet, Rubber Tree and Umbrella Tree. Certain minor pruning that removes no more than 5% of the canopy and complies with AS 4373 may also be exempt. We can confirm whether your tree qualifies before any work begins.
