Inner West Council Tree Management Rules
Inner West Council manages tree removal and pruning under its Tree Management Development Control Plan, in accordance with the State Environmental Planning Policy (Biodiversity and Conservation) 2021. Council consent is generally required before clearing a prescribed tree unless the work falls within a specific exemption.
Prescribed Trees
A tree is prescribed if it:
- Is 4 metres or more in height
- Has a trunk diameter greater than 150 mm at 1.4 metres above ground where the tree is under 4 metres in height
- Has a canopy spread of 2 metres or more
- Is a palm or tree fern with a clean stem of 4 metres or more
Approval Pathways
Pruning more than 10% of a canopy or removing a tree on a heritage-listed property, within a Heritage Conservation Area or forming part of an Aboriginal object or place of heritage significance requires a Development Application. Other prescribed tree work generally requires a Tree Works Permit.
Exemptions
Council consent is not required for certain works, including:
- Canopy lifting to 2.5 metres
- Minor pruning of branches under 100 mm in diameter, up to 10% of the canopy annually
- Deadwood removal where there is no habitat value
- Removal of a tree within 1 metre of a residential dwelling wall on the same lot, except where heritage protections apply
- Certain species on Council's declared exempt species list
Imminent Risk
Where a tree presents an imminent risk to human life or property, Council can issue expedited consent. Prior written notification must be supported by photographic evidence and an assessment from a qualified arborist (AQF Level 5) using a recognised risk assessment methodology such as TRAQ or QTRA.
Replacement Planting
Where a prescribed tree is approved for removal, Council generally requires:
- At least one replacement tree for properties under 300 m²
- At least two replacement trees for properties over 300 m²
Replacement trees are generally planted on the same site where a suitable location is available.
Development Sites
Buildings and additions must keep sufficient distance from existing trees in accordance with AS 4970 to allow practical tree retention. A security deposit may also be required where development is proposed within the Tree Protection Zone of a public tree.
Understanding these requirements early helps avoid delays and ensures the right Tree Works Permit, Development Application or arborist report pathway is followed.
