Burwood Tree Preservation Rules
Most trees in Burwood are protected under Section 6.1 (Preservation of Trees and Vegetation) of the Burwood Development Control Plan and Part 2.3 of the State Environmental Planning Policy (Biodiversity and Conservation) 2021. Council approval is generally required before removing, pruning, damaging or otherwise working on a protected tree.
- Council approval: generally required for any tree 4 metres or more in height, with a branch spread of 2 metres or more, or a trunk diameter over 150 mm measured 1.4 metres above ground.
- Applications: a Tree Permit is required for most pruning and removal on private land. Heritage items and properties in a Heritage Conservation Area need a Development Application.
- Heritage and significant trees: additional controls apply to trees associated with heritage items and Heritage Conservation Areas under the Burwood LEP and DCP.
- Exemptions: the DCP exempts certain works, including pruning dead or storm-damaged branches, hedge maintenance, mistletoe removal, limited minor crown pruning and limited root pruning where criteria are met.
- Development and tree protection: where development affects retained trees, Council may require an arborist report, Arboricultural Impact Assessment, Tree Protection Plan to AS 4970 and project arborist inspections.
