Sutherland Shire Council Tree Rules
Private trees across Sutherland Shire are protected under Chapter 39 Natural Resource Management of Council's Development Control Plan, developed under the State Environmental Planning Policy (Biodiversity and Conservation) 2021. Removal or pruning of a tree on private land generally requires Council's permission.
- Exemptions: some pruning works and species are exempt under DCP Clause 4.3 (exempt species) and Clause 4.4 (other exempt tree work), alongside the NSW RFS 10/50 Code or a Hazard Reduction Certificate.
- Heritage-listed trees: pruning needs both a Heritage Minor Works Notification and a Tree Permit Application. A DA is required instead for threatened-species native vegetation or trees forming part of an Aboriginal object or place.
- Immediate risk: no permit is needed where Council is satisfied a tree poses an immediate risk to life or property. This needs inspection and photos from a minimum AQF 4 arborist, and a SEPP Exempt Imminent Risk Form kept by owner and arborist for two years.
- Determination: applications are assessed by Council's arborists and normally determined within 28 business days. Permits are valid for two years.
- Complying Development: Council will not remove or prune a tree as part of a CDC. Refused applications are directed to the DA process.
- TRAQ reports: applications can be supported by a TRAQ report from an independent consultant (minimum AQF 4) with no affiliation to a tree contractor. Council still inspects before works start.
- If refused: options include a further TRAQ assessment by an AQF 5 consulting arborist, an appeal to the NSW Land and Environment Court, or a Council review within six months.
- Replacement planting: two replacement trees on-site, or four off-site, for every tree removed.
