Lane Cove Tree Preservation Rules
Most trees in Lane Cove are protected under the State Environmental Planning Policy (Biodiversity and Conservation) 2021 and Council's Tree Preservation Order. Council approval is generally required before removing, pruning, damaging or otherwise working on a protected tree.
- Council approval: generally required for any indigenous or exotic tree taller than 4 metres, with a canopy spread greater than 5 metres, or a trunk diameter greater than 150 mm measured 1 metre above ground.
- Applications: a Tree Preservation Order Application is required for most pruning and removal on private land. Lane Cove does not allow routine pruning of up to 10% of the canopy without approval.
- Fee-Free permits: removal of dead branches, pruning near powerlines, removal of declared noxious species, and removal of dead or dying trees not required as habitat are Fee-Free but still need a Fee-Free Tree Works Permit before work begins.
- Development and tree protection: Council may require an arborist report, Arboricultural Impact Assessment, Tree Protection Plan to AS 4970 and project arborist inspections. Trees approved for removal through a DA generally need no separate permit, while trees retained under a consent can usually only be changed through a Section 4.55 Modification Application.
- Heritage and bushland: additional controls apply to heritage items, Heritage Conservation Areas and bushland vegetation not subject to an approved plan of management.
