Blacktown City Council Tree Rules
Blacktown City Council regulates tree removal and pruning on private land under the State Environmental Planning Policy (Biodiversity and Conservation) 2021 and the Blacktown Development Control Plan, through its Tree Work Permit process. Council does not carry out tree work itself.
- Prescribed trees: a self-supporting perennial plant more than 3 metres high and/or with a trunk diameter over 200 mm, measured 1 metre above ground.
- Tree Work Permits: most pruning or removal of a prescribed tree needs a permit, assessed by Council's Urban Forest Officers through a site inspection. Applications are generally determined within 28 days.
- Heritage, biodiversity and significant trees: no Tree Work Permit can be issued for heritage-listed properties, Heritage Conservation Areas, Biodiversity Conservation Areas or trees on the Register of Significant Trees. A DA with an arboricultural assessment is required instead.
- Complying Development: removal linked to a CDC or other development can't be assessed through a Tree Work Permit, which cannot consider development as a reason for removal.
- Dead, dying and dangerous trees: deadwood or storm-damage removal needs no permit. Removing a dying or dangerous tree is exempt where supported by an AQF 5 consulting arborist's report, kept as evidence.
- 10/50 exemptions: bushfire-prone properties may use the NSW RFS 10/50 Code, except on heritage-listed, biodiversity-mapped or conservation-mapped land.
- Penalties: on-the-spot fines of up to $3,000 for individuals or $6,000 for corporations, with court penalties considerably higher.

The standard Tree Work Permit can't be used where removal is part of a CDC or other development. Your private certifier can advise on the CDC tree provisions that apply.
