Shellharbour Tree Preservation Rules

Shellharbour City Council may require a Tree Permit, Development Application (DA) or Arborist Report where proposed tree work or development affects protected trees or vegetation under Chapter 21 of the Shellharbour Development Control Plan.

  • A permit is generally required to remove, prune or otherwise damage a Declared Tree on private land unless an exemption applies. Under DCP Amendment 5, adopted June 2025, Declared Vegetation is generally defined by a height of 5 metres or more.
  • Development affecting retained trees commonly requires an Arboricultural Impact Assessment, Tree Protection Zone (TPZ) and Structural Root Zone (SRZ) assessment, together with a Tree Protection Plan prepared in accordance with AS 4970, where applicable.
  • Certain exempt species, dead or dangerous trees, and limited maintenance pruning may not require Council approval where exemption criteria are met.
  • Additional planning controls may apply to heritage properties, environmentally sensitive land and vegetation protected under other legislation.
  • The Shellharbour DCP does not apply within the Calderwood Urban Development Area, which is governed by separate planning controls.
  • Unauthorised pruning or removal may result in enforcement action and financial penalties.
