Shellharbour Tree Preservation Rules
Shellharbour City Council may require a Tree Permit, Development Application or arborist report where proposed tree work or development affects protected trees or vegetation under Chapter 21 of the Shellharbour Development Control Plan.
- A permit is generally required to remove, prune or otherwise damage a Declared Tree on private land unless an exemption applies. Under DCP Amendment 5 (adopted June 2025), Declared Vegetation is generally defined by a height of 5 metres or more.
- Development affecting retained trees commonly requires an Arboricultural Impact Assessment, TPZ and SRZ assessment and a Tree Protection Plan, prepared to AS 4970 where applicable.
- Certain exempt species, dead or dangerous trees and limited maintenance pruning may not need approval where exemption criteria are met.
- Additional controls may apply to heritage properties, environmentally sensitive land and vegetation protected under other legislation.
- The Shellharbour DCP does not apply within the Calderwood Urban Development Area, which has separate planning controls.
- Unauthorised pruning or removal may result in enforcement action and financial penalties.
