Mosman Tree Preservation Rules
Most trees in Mosman are protected under the State Environmental Planning Policy (Biodiversity and Conservation) 2021 and managed under Mosman Council's Urban Forest Management Policy. Council consent is generally required before removing, pruning or damaging a protected tree.
- Council approval: generally required if a tree is 5 metres or more in height, has a trunk circumference of 450 mm or more measured 300 mm above ground, is listed on the Urban Forest Management Register, or is 2 metres or more in height within a Heritage Conservation Area or forming part of a heritage item.
- Applications: a Tree Permit Application is required for most pruning and removal on private land. Trees protected by a Development Consent generally require a Modification Application instead.
- Heritage and significant trees: additional controls apply within Heritage Conservation Areas, heritage items and trees on the Urban Forest Management Register.
- Exemptions: listed exempt species include Rubber Tree (Ficus elastica), Privet, Umbrella Tree, Norfolk Island Hibiscus, Coral Tree, Cocos Palm, Citrus, Mulberry, Oleander, Willow and others. Deadwood removal on private land to AS 4373 is also exempt.
- Public trees: all vegetation on Council land is protected and any pruning or removal requires Council approval.
- Development and tree protection: where development affects retained trees, Council may require an arborist report, Arboricultural Impact Assessment, Tree Protection Plan to AS 4970 and project arborist inspections during construction.
