Ku-ring-gai Council Tree Rules
Trees and vegetation across Ku-ring-gai are protected under the State Environmental Planning Policy (Biodiversity and Conservation) 2021, administered through a permit process in Council's Tree and Vegetation DCP (Part 13). This applies across the whole council area, excluding National Park land.
- Protected trees: a perennial plant with a self-supporting woody, fibrous stem, native or exotic, that is 5 metres or more in height or has a trunk diameter of 150 mm or more at ground level.
- Common exemptions: removal of completely dead trees and dead branches, removal of a tree within 3 metres of an approved existing residential building on the same property (measured from trunk centre to external wall), and branches within 0.5 metres of electrical service lines.
- Dead trees: not automatically exempt. Council must first confirm in writing that the tree is dead and isn't required as native fauna habitat.
- Heritage exclusions: none of the standard exemptions apply on a Heritage Item property or within a Heritage Conservation Area. A Tree Application or Development Application is required regardless of size.
- Other legislation: works authorised under the Rural Fires Act, Electricity Supply Act, Roads Act or Biosecurity Act don't need separate Council consent, provided the relevant authorisation is obtained.
- Development Consent: trees approved for removal under a Development Consent don't need a separate permit once the Construction Certificate is issued.
