Central Coast Council Tree Rules
Central Coast Council protects trees on privately owned land under Chapter 3.5 Tree and Vegetation Management of its Development Control Plan, made under the State Environmental Planning Policy (Biodiversity and Conservation) 2021.
- Protected trees: a Private Tree Works application is required for a tree over 3 metres in height with a trunk diameter greater than 75 mm, measured 1.4 metres above ground level.
- Proximity to buildings: an application is also required to prune or remove a tree more than 3 metres from a Council-approved building such as a house, garage or pool, measured 1 metre above ground between the wall and the nearest part of the trunk.
- Building and pool works: tree removal or pruning connected to construction or a pool is assessed through the DA or CDC process, not the standard Private Tree Works application.
- Exemptions: dead trees, non-native shrub, understorey and groundcover maintenance, native shrub and groundcover maintenance up to 50 m², and pruning up to 10% of foliage per growing season to AS 4373 don't need a permit. Vegetation eligible under the NSW RFS 10/50 Code is also exempt.
- Dead, dying or imminent-risk trees: Council will generally be satisfied without a formal application where evidence from a Consulting (AQF 5) Arborist, including photos and written advice on species and condition, is kept for 12 months and provided on request.
- Application limits: applications cover up to 5 trees not part of a vegetation community. Council won't accept multiple 5-tree applications for one property, or a new application within 12 months of the last.
- Not valid reasons for removal: consent won't generally be given where the complaint relates to leaf fall or view enhancement.
- Appeals: you can appeal a determination to the NSW Land and Environment Court within 3 months.
