  • A Tree Permit or Development Consent is generally required for trees on non-rural land that are more than 5 metres in height, more than 5 metres in crown width, or have a trunk circumference greater than 500 mm measured 1 metre above ground level, unless an exemption applies.
  • The Gordon Timbs 45 Degree Rule provides an exemption for tree removal or substantial pruning within a 45-degree angle of a lawfully erected building where the tree poses a short-term risk to that building, subject to species exclusions and the criteria set out in the DCP.
  • Most tree removal and substantial pruning on private land requires a Tree Permit lodged through the NSW Planning Portal. Where tree removal forms part of a Development Application, the arboricultural assessment is generally considered through the DA process.
  • Different requirements apply on RU1, RU2, RU3 and RU4 rural-zoned land, where approvals are generally managed through Local Land Services rather than Council.
  • Approval is generally not required for trees under the protected size thresholds, exempt tree species, eligible works under the NSW Rural Fire Service 10/50 Vegetation Clearing Scheme, trees posing an imminent threat to human life or significant property, or where approval is available under other legislation.
  • Additional protections may apply to threatened species, endangered ecological communities, heritage items and environmentally sensitive land.

Do I need Council approval to remove a tree?

In most cases, yes. Most tree removal and major pruning on non-rural land requires either a Tree Removal Permit or Development Consent, depending on the circumstances and whether the work forms part of a Development Application.

How does lot size affect what approval I need?

Clearing thresholds scale with your minimum lot size, generally 0.25 hectares or more for lots under 1 hectare, and 0.5 hectares or more for lots between 1 and 40 hectares. Clearing above these thresholds, or on land shown on the biodiversity values map, may require Native Vegetation Panel approval rather than a Council permit.

Can a Complying Development Certificate be used to remove a protected tree?

No. Protected trees, including any listed on Eurobodalla's Significant Tree Register, cannot be removed as part of a Complying Development Certificate and will still require protection during nearby construction.
